Franchising Need Not Be an Operational or a Legal Minefield

Author Richard Solomon is a Franchise Lawyer with four decades of experience in business development, antitrust and franchise law, management counseling and dispute resolution including trials and crisis management.

The need to readjust methods, to reestablish operational discipline, to modify the system to keep it fresh, and to know where you are in your life cycle are common to all businesses. There will always be some problems, but their criticality is the key question. Your management may not, whether because of loyalty or closeness to the fire, be able to bring detached insight to that question, followed by non mission-biased remedial options. Doctors don't operate on their children for much the same reason - too much love to be objective.

Objectivity is required for both strategic and administrative issues in franchising. Identifying non-performing aspects of your business, updating what has become obsolete, modifying relationships to incentivize improvement in your connections with your best franchisees, recognizing the impact of life cycle dynamics and what is required to deal with it, are all high impact factors the accomplishment of which is more difficult for the insider. Mentoring, experienced outside assistance is of great value.

Through countless experiences in counseling and in dispute resolution, we bring those insights to your aid. The insight is both legal and managerial. It is designed to help, not scare the hell out of you. Justknowing the law simply isn't enough.
